Welcome to Vinavian! These Terms and Conditions (“Terms”) govern your access to and use of the Vinavian mobile application (“App”), provided by Vinavian (“we,” “us,” or “our”). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, please refrain from using the App.

1. Acceptance of Terms

By using the App, you confirm that:

• You have reached the legal drinking age required in your country or region of residence. The legal drinking age varies across jurisdictions, and it is your responsibility to ensure compliance with the applicable laws in your location.
• You have the full legal capacity to enter into binding agreements under applicable law.
• You will abide by all applicable laws and regulations when using the App.

If we determine that you do not meet these requirements, we reserve the right to terminate your account immediately without notice.

2. Scope of Services

Vinavian is a mobile app designed for wine enthusiasts to create and manage a personal wine collection, add, rate, and review wines, scan barcodes for wine recognition, record details and analyze wine preferences.

The App includes both free and paid features, with the paid version offering additional functionality such as an ad-free experience, enhanced analytics, and greater customization options.

3. User Responsibility

By using the App, you agree that you are solely responsible for:

• Maintaining the confidentiality of your account credentials. Any activities conducted through your account are your responsibility.
• Providing accurate and complete information when using the App and refrain from submitting misleading or unlawful content.
• Ensuring that any content you submit (such as reviews, ratings, photos, or comments) complies with applicable laws and does not violate third-party rights.
• Any actions taken within the App, including interactions with other users and the use of information provided in the App.
• You agree to use the App in compliance with all applicable laws and regulations.
• Your compliance with all applicable alcohol-related laws in your jurisdiction, including but not limited to consumption, purchasing, and distribution laws.

You acknowledge that the App does not endorse, promote, or encourage excessive alcohol consumption, and you agree to use the App responsibly.

4. License

We grant you a limited, non-exclusive, non-transferable, and revocable license to use the App for personal and non-commercial purposes. You agree not to:

• Reverse engineer, decompile, modify, or create derivative works based on the App.
• Use the App for unlawful purposes or in violation of any applicable laws.
• Attempt to bypass any security measures implemented within the App.

5. Prohibited Conduct

You agree not to use the App in any manner that:

• Promotes or facilitates illegal activities, including but not limited to underage drinking, excessive alcohol consumption, or distribution of alcohol to minors.
• Harasses, threatens, abuses, or discriminates against any individual or group.
• Contains or promotes hate speech, violence, or sexually explicit content.
• Submits false, misleading, or fraudulent information.
• Violates any third-party intellectual property or privacy rights.
• Attempts to interfere with the operation, security, or integrity of the App, including hacking, introducing malware, or engaging in unauthorized data scraping.
• Uses automated systems (e.g., bots, scripts) to interact with the App.
• Attempts to gain unauthorized access to any portion of the App, its servers, or related systems.

Violation of these terms may result in immediate suspension or termination of your access to the App, without prior notice or liability.

6. User Contributions

Users may upload and submit information, comments, reviews, ratings, and photos. By submitting content to the App, you grant us a non-exclusive, worldwide, royalty-free, perpetual license to use, display, reproduce, and distribute your content in connection with the operation and promotion of the App.

You represent and warrant that:

• You own or have the necessary rights to submit the content.
• The content does not infringe any third-party rights, including intellectual property or privacy rights.
• The content is truthful and not misleading.

We reserve the right to remove or modify any user-generated content at our sole discretion.

8. Subscription Plans and Payments

The App is available in a free version with basic features. A paid subscription unlocks additional premium features, such as advanced learning tools, detailed statistics, ad-free usage, and enhanced customization.

Subscriptions are billed on a recurring basis (e.g., monthly or annually) as per the selected plan. Unless canceled, subscriptions renew automatically at the end of each billing cycle.

All payments are non-refundable unless required by applicable law.

Payments are processed through third-party platforms, and by making a purchase, you agree to their respective terms and conditions. We do not store credit card details.

We reserve the right to modify or discontinue premium features at any time without liability.

9. Intellectual Property

The App, including its design, logo, features, and content, is the intellectual property of Vinavian and protected under applicable copyright and trademark laws.

Users may not reproduce, distribute, or create derivative works from any content within the App without prior written consent.

10. Disclaimer of Warranties

The App is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied. We do not guarantee:

• The accuracy, reliability, or completeness of any information in the App.
• That the App will be uninterrupted, error-free, or free from harmful components.
• That the App will meet your expectations or requirements.

Your use of the App is at your own risk.

11. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any direct, indirect, incidental, consequential, or punitive damages arising from:

• Your use of or inability to use the App.
• Errors, omissions, or inaccuracies in the App.
• Interruption, hacking, or unauthorized access to the App.
• Loss of data, profits, business, or goodwill.

In no event shall our total liability exceed the amount paid by you if any for accessing the App during the one-month period preceding the event giving rise to the liability.

You agree to indemnify, defend, and hold harmless Vinavian, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising from:

• Your use of the App.

You may discontinue use of the App at any time by deleting your account and the App from your device.

We reserve the right to suspend or terminate your access to the App at our sole discretion, with or without prior notice, for any reason, including a breach of these Terms.

We may update these Terms at any time. Any changes will be effective upon posting to the App. Your continued use of the App constitutes acceptance of the updated Terms.
